Pretty simple, use it as momentary and it will work as momentary. Use it as latching, it will work as latching.
How? When user press the button more than N miliseconds (500 aprox?) make latching to behave like momentary.
This is very helpful with scenes and stomps that we currently use for long periods of time but also want them to be in short periods (like 4 seconds or less) and want to avoid the annoyance to press quickly another button to go back previous state which might introduce mistakes.

It’s a cool idea, but it could be perceived as confusing by some users. For example, if you release the footswitch (even just slightly) before the threshold time, you could end up unintentionally latching the effect. Under the pressure of a live performance, that kind of mistake can be pretty disruptive.
More importantly, this behavior would conflict with scenarios where players want a very short momentary action—for example, triggering a quick pitch-up effect or engaging reverb/delay trails for just an instant. In those cases, the timing threshold could get in the way rather than help.
One way around this would be to add it as a third footswitch assignment option, for example:

Momentary

Auto Latch/Momentary
That way users can explicitly choose their preferred behavior and avoid unexpected results.
It would arguably be most useful if Auto Latch/Momentary became the new default, but I doubt Neural would want to implement it that way given the potential for confusion.

yes I dont think this behavior should be by default. your idea of a 3rd option seems pretty good
